JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 This is an application for grant of anticipatory bail in connection with Ahiyapur P.S. Case No. 1078 of 2018, disclosing offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Allegation is of recovery of huge quantity of liquor from a bus and tempo and the petitioner's motorcycle was also parked there.
Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case due to the fact that his motorcycle was also parked at the spot from where the recovery was made. Further, he has no criminal antecedent and nothing has been recovered from his motorcycle. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 1078 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
