JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that the victim was recovered from the house of the petitioner, I am not inclined to grant privilege of bail, Accordingly, his prayer for bail in connection with Bela P.S.Case No. 21 of 2014, pending in the court of Judicial Magistrate 1st class, Sitamarhi stands rejected. However, the concerned court should commit the case of the petitioner to the court of Session in accordance with law within four weeks from the date of receipt/ production of copy of this order, if the same has not been committed to the court of session as yet and after commitment of the case, concerned court should expedite the trial of the petitioner and try to conclude the

It is made clear that if the trial of the petitioner is not concluded within nine months from the date of commitment order the petitioner shall be at liberty to renew her prayer for bail before the learned trial court itself.
