JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned A.C. to A.A.G.-13 for the respondents.

The present writ application has been filed for a direction to the respondent authorities to release the vehicle (truck) of the petitioner bearing Registration No. BR-44-G/2235, which has been seized in connection with Forest Case No. 06 of 2014. It is submitted by the learned counsel for the petitioner that in pursuance to the institution of the Forest Case No. 06 of 2014, Confiscation Case No. 94 of 2014 was initiated. The Divisional Forest Officer cum Authorized Officer, Rohtas,

Patna High Court CWJC No.7077 of 2017 (2) dt.03-07-2017 2/2 Sasaram vide order dated 16.12.2014, passed in Confiscation Case No. 94 of 2014, confiscated the truck in question along with loaded stone chips. The confiscation order was challenged in Forest Confiscation Appeal Nos. 5, 6 and 7 of 2015, in the court of Collector, Rohtas who, vide order dated 17.06.2015, upheld the confiscation order and thereby dismissed the appeal. The appellate order has been challenged in Forest Revision No. 21 of 2015 before the Secretary, Department of Forest and Environment, Government of Bihar which is pending since 06.07.2015. Hence, at present the petitioner confines his prayer only for a direction for disposal of the Forest Revision Case no. 21 of 2015.

In the circumstances, the Secretary, Forest and Environment is expected to dispose of the Forest Revision Case No. 21 of 2015 preferably within a period of six weeks from the date of receipt/production of the copy of present order. Accordingly, the present writ application is disposed of.
