1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The present application has been filed for modification of the order dated 22.11.2024 passed in Cr. Misc. No. 4285 of 2024 whereby the present petitioner has been granted privilege of anticipatory bail subject to the condition that the petitioner shall surrender before the learned court below within a period of four weeks from the date of order.
3. Learned counsel for the petitioner submits that due to illness the petitioner could not pay the amount as per condition laid down vide order dated 22.11.2024 and failed to furnish bail
Patna High Court CR. MISC. No.7955 of 2025(3) dt.14-02-2025 2/2 bond within stipulated time. Learned counsel next submits that at the time of surrender the petitioner shall pay the entire amount of Rs. 250,000/- to the Opposite Party No. 2. He, accordingly, prays for further three weeks time to surrender before the learned District Court.
4. Having regard to the submissions made on behalf of the petitioner, let the time granted by this Court to surrender before the learned court below by order dated 22.11.2024 passed in Cr. Misc. No. 4285 of 2024 be extended by further three weeks from today subject to the condition that the petitioner shall pay the entire amount of Rs. 2,50,000/- as a condition of bail given in the order dated 22.11.2024 at the time of furnishing bail bond.
5. Accordingly, this application is allowed to the extent indicated above.
