The petitioner seeks bail in connection with S.T. No. 12 of 2018, arising out of Bettiah Town P.S. Case No. 91 of 2015, registered under Sections 379, 411 and 413 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that while petitioner was not named in the F.I.R., but in course of investigation the petitioner was apprehended and on the basis of his confessional statement, the stolen vehicle was recovered near the temple. Further submission is that petitioner is in custody since 02.05.2015, but up till now, charge has not been framed against the petitioner

Patna High Court CR. MISC. No.2681 of 2019(3) dt.13-03-2019 2/2 and there is no chance of disposal of the case of the petitioner in near future.

A report, as called for, regarding the present stage of trial, has been received from the Court of Addl. Sessions Judge-IV, Bettiah, West Champaran vide Letter no. 75, dated 08.02.2019, which disclosed that record is running for framing of charge on 31.07.2017, but other co-accused did not turn up due to that reasons their bail bond has been canceled and record is running for appearance of rest accused.

Having regard to the facts and the circumstances of the case and period of detention, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Bettiah, West Champaran in connection with S.T. No. 12 of 2018, arising out of Bettiah Town P.S. Case No. 91 of 2015. (Rajendra Kumar Mishra, J) manish/- U T
