Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code. Petitioner is said to have given rod blow causing head injury to the informant's wife at three places. The doctor found two injuries on the head of the informant's wife whereas third injury is said to be pain in whole body. The doctor opined that the aforesaid injuries were caused by hard and blunt substance but grievous in nature but there is nothing in the report of the doctor to show as to on which basis doctor came to the above stated conclusion regarding the nature of the injury.
Moreover, there is case and counter case between the parties and the petitioner, too, sustained injury in the alleged

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Teragacch P.S.
