Petitioners are in custody since 10.03.2016 in connection with Kasim Bazar P.S.Case No.29 of 2016 registered for the offence under Sections 147, 148, 149, 307 and 506 of the IPC and Section 27 of the Arms Act.
As per the prosecution case, it is alleged by the informant that on 09.03.2016 at about 6 A.M. in the morning suddenly Jai Kishore Yadav, petitioner no.1 and his two sons and four other accused had come to the house of the informant and started firing continuously and forbidden to give evidence in Prashasnt's murder case otherwise all the family members of the informant will be killed and when the informant opposed, all the
Patna High Court Cr.Misc. No.18076 of 2016 (3) dt.25-05-2016 accused persons fired on the house of the informant. It has been submitted on behalf of the petitioners that the petitioners are in custody since 10.03.2016. Chargesheet has been submitted in the case. Petitioners have got no criminal antecedent. The informant and the petitioners are own brother and nephew respectively. No injury has been attributed against the petitioners. The alleged occurrence is said to have taken place due to property dispute. It is a case and a counter case between the parties. On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Munger in connection with Kashim Bazar P.S.Case No.29 of 2016.
