Petitioner is not named in the first information report and it is obvious from perusal of the impugned order that in course of investigation, witnesses claimed to have seen the petitioner and others in the company of the deceased, prior to the alleged occurrence and therefore, even if, the aforesaid statement assumed to be true, then also, it is a case of last seen only.
Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
Patna High Court Cr.Misc. No.26922 of 2015 (2) dt.03-08-2015 2/2 each in connection with Sare P.S. Case No. 101 of 2014 to the satisfaction of Learned Chief Judicial Magistrate, Nalanda at Bihar Sharif.
