Although, petitioner has prayed for quashing of Memo No.398 dated 27.10.2018 and Memo No.122 dated 28.11.2018 as contained in Annexures '4' and '5' respectively to the present writ application, Mr. Alok Ranjan, learned counsel representing the petitioner submits that, at this stage, he would not be pressing for those reliefs and would be looking only for a direction to the District Magistrate, East Champaran to consider his representation as contained in Annexure '6' and take a decision thereon in accordance with law.

Patna High Court CWJC No.24533 of 2018(2) dt.14-02-2019 2/2 Learned counsel for the State submits that he would have no objection if the writ application is disposed of with a direction to the District Magistrate, East Champaran to look into the grievance of the petitioner and consider the same keeping in mind the Rules on this behalf.

In the given facts and circumstances of the case, this writ application is being disposed of with a direction to the District Magistrate, East Champaran to look into the grievance of the petitioner as contained in Annexure '6' to the writ application and take a decision thereon keeping in mind the relevant Rules and Guidelines of the Government. In case, his decision is likely to effect respondent no. '6', such a decision shall be taken only after giving an opportunity of hearing to the respondent no. 6. The whole exercise in this regard will be completed within a period of 90 days from the date of receipt/production of a copy of this order.
