JUSTICE AMARESH KUMAR LAL ORAL ORDER 03-08-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 504, 506, 427, 353, 307/34 of IPC and Section 3(1)(X) of the S.C./S.T. (Prevention of Atrocities) Act.
Allegation against the petitioner is that he came out from the queue of the persons depositing forms for grant of benefit under social welfare scheme which was objected by the informant, thereafter, the petitioner abused the informant.
Block Development Officer came to pecify the matter even thereafter the petitioner threatened. Later on, the petitioner was apprehended and locked in the guard room.
Patna High Court Cr.Misc. No.27640 of 2015 (2) dt.03-08-2015 2/3 Learned counsel for the petitioner submits that there is no specific allegation of overtact against the petitioner. The petitioner is a social worker and he has been falsely implicated in this case. However, after investigation charge-sheet has already been submitted and there is no chance of tampering with the witnesses.
Learned counsel for the State submits that the petitioner has also criminal antecedents.
Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned SDJM, UdaKishunganj, Madhepura/court concerned after framing of charge in Alamnagar P. S. Case No. 49 of 2015 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond
Patna High Court Cr.Misc. No.27640 of 2015 (2) dt.03-08-2015 3/3 would be liable to be cancelled by the learned Court concerned.
