Petitioner is languishing in custody since 26.12.2015 in a case registered for the offences punishable under Sections 20(b), 22, 25, 29 of the Narcotics Drugs and Psychotropic Substances Act.
The prosecution case is that from the possession of the petitioner 9.00 K.g. ganja was recovered. It is submitted by the learned counsel for the petitioner that recovery is between small and commercial quantity. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the quantity of recovery and petitioner being in jail more than nine months, let the above named petitioner, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.19423 of 2016 (7) dt.30-09-2016 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Aurangabad, Bihar in connection with Jamhore P.S. Case No. 104 of 2015.
The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner got involved in some serious offence or defaults without any reasonable cause on three consecutive occasions. (Dinesh Kumar Singh, J) P.K./- U T
