Learned State counsel accepts notice for respondents. Learned counsel for the petitioner is hereby directed to learned counsel for the State if it has not already served. In the instant petition, petitioner has prayed for the following relief(s):- "For a direction to the respondents to consider the case of the

Patna High Court CWJC No.4804 of 2021 dt.01-02-2022 2/2 petitioner for grant of the benefit of MACP as the petitioner has already completed 30 years of qualified service on 26. 09.2006."

Short question for consideration is whether the petitioner is entitled to 3rd MACP as of when it is due to him. In this regard, representation dated 15.12.2020 is stated to have been furnished as is evident from Annexure-1.

Therefore, the concerned respondent is hereby directed to decide the petitioner's representation for the 3rd MACP and arrears shall be calculated and disbursed to the petitioner within a period of three months from the date of receipt of this order. If the petitioner is not eligible in that event speaking order shall be passed and communicated to the petitioner.

With the aforesaid observations, the present writ petitioner stands disposed off.
