The petitioner seeks bail in a case for the offences punishable under sections 328, 302/34 of the I.P.C The prosecution story, in brief, is that it is alleged that elder brother of the informant namely, Mithilesh @ Munna Thakur had murdered by the petitioner and other accused persons due to the fact that he had sold six katha of land to one Vijay Sahani through Radhey Thakur whose registered sale deed was not prepared.
On behalf of the petitioner it has been submitted that the petitioner is in custody since 22.2.2015. Charge sheet has been submitted in the case. It has been submitted that the petitioner has
Patna High Court Cr.Misc. No.26770 of 2015 (2) dt.28-07-2015 2/2 been falsely implicated in the present case due to property dispute. There is no direct evidence to suggest implication of the petitioner in the present case.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Saharsa in Saharsa Sadar P.S. Case No. 631 of 2014.
