JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 147, 148, 149, 353 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner and other F.I.R. named accused is said to have open indiscriminate fire on police party causing fire arm injury to one police officer. Petitioner carries criminal antecedent of several cases and he could be remanded in this case on 10.02.2014 whereas the present case was lodged in the year 1999. However, the charge has clearly been framed against the petitioner and his trial has commenced.

Therefore, considering the previous conduct of the petitioner as well as allegation levelled against the petitioner, I am

Patna High Court Cr.Misc. No.18842 of 2016 (2) dt.03-05-2016 2/2 not inclined to release the petitioner on bail. Accordingly, his prayer for bail in connection with Bihara P.S. Case No. 60 of 1999 (Sessions Case No. 55 of 2014) pending in the court of learned 1st Additional Sessions Judge, Saharsa stands rejected.
