====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 448, 341, 323, 307, 337, 354(B), 379, 427 and 504 of the Indian Penal Code. As per prosecution case, it is alleged that all the F.I.R. named accused persons including this petitioner, armed with weapons, came at the house of the informant and assaulted the informant and others. It is further alleged that they also snatched gold ear-rings.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, co-accused, namely, Rita Devi had earlier lodged a case bearing SC/ST Lakhisarai P. S. Case No.

Patna High Court CR. MISC. No.5273 of 2023(2) dt.11-05-2023 2/2 20 of 2022 and only with a view to save the skin, this false case has been lodged against the petitioner. He next submits that no specific and overt act has been alleged against the petitioner and he has got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Tetarhat P. S. Case No. 43 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
