The petitioner seeks bail in a case registered for the offences punishable under Sections 366, 376 and 120B of the Indian Penal Code.

The prosecutrix made allegation that Raushan Poddar and Ranjan Poddar came to her Sasural and Raushan Poddar on his motorcycle took her to different places and also committed rape with her. The prosecutrix did not make any allegation against the petitioner Ranjan Poddar in her statement before the police. The petitioner is only alleged to have accompanied Raushan Poddar to the house of the prosecutrix, but he did not either kidnap the victim or make any efforts to kidnap her.
