JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-341, 326, 307 of the Indian Penal Code. It is alleged that petitioner gave one Farsa blow, causing injury on the neck of informant's father and the said injury was found grievous in nature.
Submission on behalf of petitioner is that a free fight took place between the petitioner and the injured of this case but in course of aforesaid free fight, the informant of the present case as well as his supporters came there and badly assaulted the petitioner, for which, the petitioner, too, lodged Guraru P.S. Case No. 103 of 2015 against the prosecution party. Moreover, the

No.20211 of 2016 (2) dt.09-05-2016 2/2 petitioner is languishing in jail custody since 29-12-2015 and the investigation against him has already been completed Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Guraru P.S. Case No. 102 of 2015 to the satisfaction of Sri Rohit Kumar, learned Judicial Magistrate-Ist Class, Gaya.
