JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2019 The learned counsel for the petitioner submits that the case of the petitioner is covered by a judgment rendered by the Hon'ble Apex Court dated 2.7.2013 passed in the case of Vishwanath Pandey vs. The State of Bihar & Ors. as reported in 2013(3) PLJR 305(SC).

Per contra, the learned counsel for the respondents submits that the respondent no. 7 shall examine as to whether the case of the petitioner is similar to the case of Vishwanath Pandey (supra).

Patna High Court CWJC No.24351 of 2018(2) dt.01-05-2019 2/2 Having regard to the consensus arrived between the learned counsel for the respective parties, the present writ petition is disposed of in terms of the aforesaid judgment dated 2.7.2013 passed in the case of Vishwanath Pandey vs. The State of Bihar & Ors. as reported in 2013(3) PLJR 305(SC) and the respondent no. 7 is directed to consider the case of the petitioner and in case, it is found that the petitioner is similarly situated, the same relief as has been granted to the appellant of the aforesaid case shall also be granted to the petitioner herein. The entire exercise regarding examination of the case of the petitioner and grant of similar relief as granted to the appellant of the aforesaid case should be completed within a period of twelve weeks from today.

The present writ petition stands disposed of on the aforesaid terms.
