====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Barhariya P.S. Case No. 422 of 2019 for the offenses under Sections 272 and 273 of I.P.C. and 30, 30(a), 34(b), 36, 38, 41(i) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 30 ltrs of Mahuwa wine was seized. It is further submitted that the petitioner is in custody since 19.12.2019.

Considering the fact that the petitioner has got a clean antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand)

Patna High Court CR. MISC. No.5365 of 2020(2) dt.31-01-2020 2/2 with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II cum Special Judge (Excise), Siwan, in connection with Barhariya P.S. Case No. 422 of 2019.
