The petitioner seeks anticipatory bail in connection with Complaint Case No. 435 ( C )/2018, registered for offences punishable under Sections 323, 498 (A), 307 and 313 of the Indian Penal Code and under Section 3/4 of Dowry Prohibition Act.

Allegation as per F.I.R. against the petitioner, who happens to be the husband of the daughter of the complainant is of subjecting his wife with cruelty due to non fulfillment of demand of a motorcycle and cash of Rs. 40,000/-. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and the petitioner is ready to keep the daughter of the complainant with dignity and care but as a matter of fact, daughter of the opposite party No.2 is not ready to live with the petitioner.

Patna High Court CR. MISC. No.5487 of 2019(3) dt.27-03-2019 2/2 Heard learned A.P.P. as well as learned counsel for the informant, who opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances as discussed above, let the petitioner, above named surrender within a period of six weeks from the receipt of this order and file a petition that he is ready to keep his wife with full dignity and care, on which the learned court below shall issue noticeto the daughter of Opposite Party No. 2 and petitioner shall be released on provisional bail to his own satisfaction with the condition that he will appear alongwith his wife within 15 days from his released and the learned court below shall watch the conduct of both the parties for a period of six months, bail bond of the petitioner shall be confirmed, otherwise the learned court below is free to pass any other order or orders, which may be deemed fit and proper, including cancellation of bail.

With the above observation, this application is disposed of.
