JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 This is an application for grant of anticipatory bail in connection with Seikhpura P.S. Case No. 32 of 2018, disclosing offences under Sections 498(A), 323, 34 of the Indian Penal Code and Section 3/4 of the D.P. Act.

Allegation against the petitioner is of subjecting his wife to cruelty and harassment with respect to demand of dowry. Submission of learned counsel for the petitioner is that he is still ready to keep her with full dignity and care and the whole allegation is false and concocted.

Heard learned A.P.P. as well as learned counsel for the complainant, they have opposed the prayer for anticipatory bail of the petitioner stating that the activities of the petitioner is

Patna High Court CR. MISC. No.4899 of 2019(3) dt.13-03-2019 2/2 criminal minded and she has lodged a case against him though after filing of this case and she has also filed a maintenance case before the Family Court, Seikhpura.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Seikhpura, in connection with Seikhpura P.S. Case No. 32 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that he will not threaten in any way to opposite party no.2/complainant and also cooperate in the disposal of the maintenance case filed the opposite party no.2 and will abide by any order passed by the Family Court.
