JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she specifically stated that she being major solemnized her marriage with the petitioner but learned 1st Additional Sessions Judge, Vaishali at Hajipur rejected the regular bail application of the petitioner only on the ground that father of victim had filed photostat copy of horoscope said to be of victim and in the aforesaid horoscope, birth of year of the victim had been entered as 2001.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.26965 of 2015 (2) dt.28-07-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 29 of 2015.
