Originally, the case was registered under Sections304(B)/34 of the Indian Penal Code but after investigation, police submitted charge sheet under Sections-302, 201/34 of the Indian Penal Code.

In course of investigation, son of the deceased stated that his mother died of her ailment and furthermore, the local Chowkidar at paragraph-21 of the case diary, stated that the deceased had illicit relationship with one Sudhir Rai and that was the reason of her murder. Furthermore, there is no one to claim himself to be eye witness of the alleged occurrence and except the above-said circumstantial evidence, there appears to be nothing against the petitioner.

Patna High Court Cr.Misc. No.27320 of 2014 (4) dt.15-01-2015 2/2 Accordingly, the petitioner named-above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Runnisaidpur P.S. Case No. 408 of 2013 to the satisfaction of Chief Judicial Magistrate, Sitamarhi.
