JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under various sections of the Arms Act. Petitioner is said to have been caught on the spot and on the basis of his disclosure, some semi-finished pistols and other articles were recovered from a hut.

Submission on behalf of the petitioner is that petitioner is in jail custody since 15.11.2014 and as a matter of fact, he was caught by the police at the instigation of local Chowkidar with whom petitioner has some differences. Moreover, petitioner does not have any criminal antecedent, except one case which had been lodged for the offences punishable under Sections

Patna High Court Cr.Misc. No.19018 of 2016 (2) dt.05-05-2016 2/2 341, 335, 307 of the Indian Penal Code.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No. 254 of 2014.
