The petitioners seek bail in connection with Bhairav Asthan P.S. Case No. 117 of 2024 instituted for the offence under Sections 76, 109, 115(2), 121(1), 121(2), 126(2), 132, 324(5), 343, 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

As per prosecution case, when the police party reached at the house of co-accused, namely, Sheikh Ataullah, Sheikh Rizwan (petitioner No.2) & others for execution of Non Bailable Warrant, they accosted by several locals including the petitioners in discharging their duty, whereafter a scuffle ensued

It has been submitted on behalf of the petitioners that the petitioners are in custody since 17-11-2024. Petitioners bear one criminal antecedent each, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. It is submitted that petitioners have no concern at all with the alleged occurrence. There is no specific allegation against the petitioners, rather allegation is general and omnibus in nature. Injuries as alleged in the FIR are totally false and concocted and the same is found by doctor to be simple in nature. Learned counsel submits that other co-accused has been granted bail from the lower court itself.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioners and manner of petitioner's implication, this Court is inclined to grant bail to the petitioners.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each
Patna High Court CR. MISC. No.5272 of 2025(2) dt.06-02-2025 3/3 with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bhairav Asthan P.S. Case No. 117 of 2024.
