In this case, the petitioner is seeking anticipatory bail in connection with Baisi P.S. Case No.129 of 2018, registered for the offence under Sections 323, 341 and 504/34 of the Indian Penal Code. Later on, Section 307 of the Indian Penal Code was also added.

Allegation has been made that the accused were carrying fire-wood in a tractor, on that account, the electric wire was broken and when the informant objected, the accused person came there with lethal weapons and assaulted the informant. Allegation has been made against the present petitioner to have caused injury by Khunta.

It appears from the case diary that all the witnesses

Patna High Court Cr.Misc. No.4171 of 2019(3) dt.21-02-2019 2/2 have made statement against the petitioner.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
