None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-02-2019 Heard learned counsel for the petitioners. No one appears on behalf of the State to oppose this application. Petitioners are seeking anticipatory bail in connection with Khagaria P.S. Case No. 729 of 2018 registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that though in the FIR mother of the victim girl made an allegation that these petitioners had taken away her daughter, but the

She has made statement under Section 164 Cr.P.C. in which she informed that on 19.10.2018 she had gone to the place of a distance relation and thereafter she called Brahmshil Kumar (petitioner no.2) to the house of her relation and solemnized marriage with him on 02.11.2018. The victim girl has also stated that she was in love with Brahmshil Kumar and wanted to avoid the marriage which was being fixed by her parents. The age of the victim girl has been shown as 18 years in her statement under Section 164 Cr.P.C.

In the given facts and circumstances of the case considering the statement of the victim girl under Section 164 Cr.P.C. and that these petitioners have got no criminal history, in case of arrest or surrender of the petitioners within a period of four weeks from today, the abovenamed petitioners shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) each with two sureties of the like amount each to the satisfication of the learned C.J.M., Khagaria in connection with Khagaria P.S. Case No. 729 of 2018, subject to the condition that petitioners shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation.
