2. The petitioners seek bail in a case registered for the offence punishable under Sections 341, 323, 498(A), 307, 304B/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.
3. As per the prosecution case, the petitioners along with other co-accused persons are said to have tortured and assaulted the niece of the informant due to non-fulfillment of dowry demand and dropped informant's niece from a Tampoo at his door, who was about to die and fled away, then the informant brought his niece to the hospital for her treatment.
4. Learned counsel for the petitioners submits that no such occurrence as alleged ever took place. They are quite innocent and have been falsely implicated in this case. The
Patna High Court CR. MISC. No.7116 of 2024(2) dt.10-04-2024 2/2 allegation levelled against the petitioners is not specific rather general and omnibus in nature. He submits that the petitioner no. 1 is husband of the deceased and petitioners no. 2, 3 and 4 are in-laws of the deceased. He further submits that the deceased was an acute bronchitis Asthma patient and she died due to her disease. The petitioners has no criminal antecedent and petitioners no. 1 to 3 has been languishing in custody since 09.11.2023 and petitioner no. 4 is languishing in custody since 25.11.2023.
5. Learned APP for the State opposed the bail petition.
6. Considering the facts aforesaid and the custody of the petitioners, the above named petitioners is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Pipra P.S. Case No. 59 of 2022.
