Petitioner is accused in connection with Kadam Kuan P.S. Case No. 12 of 2016 registered under Section 392 of the I.P.C.
The accusation is of snatching of mobile phone of the informant by two unknown boarded on motorcycle on 07.01.2016 at 7.00 am. At that time, the informant saw the number plate but he read only digit as 7675. After two days, the informant disclosed the full Registration number of motorcycle as BR1AK 7675.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the informant has
Patna High Court Cr.Misc. No.19683 of 2016 (2) dt.10-05-2016 2/2 not disclosed the full number of motorcycle. He disclosed the full Registration No. BR1AK7675 of the motorcycle, which belongs to petitioner, in his written report after three days of occurrence which he was not able to read the full registration number at the time of occurrence. Further it is submitted that petitioner has no criminal antecedent and is in custody since 10.01.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna in connection with Kadam Kuan P.S. Case No. 12 of 2016. Out of two sureties, one surety must be parents or close relatives of the petitioner. (Rajendra Kumar Mishra, J) Shail/- U T
