The petitioner seeks bail in connection with Gopalganj Town P.S. Case No. 158 of 2014, Trial No. 04 of 2014 for the offences punishable under sections 379 and 411 of the Indian Penal Code.

The prosecution case, in brief, is that the informant was sleeping in his under construction house keeping his motorcycle outside in the night of 3-4-2014, which was stolen away by unknown miscreants.

It has been submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. Further, it is submitted that the petitioner in good faith was moving on the stolen motorcycle without any knowledge that the motorcycle in question on which the petitioner was moving is stolen property, and the

Further, it is submitted that no T.I. Parade has been conducted to prove the participation of the petitioner in the present case.

It is further submitted that the petitioner is in custody since 9-9-2014.

On behalf of the State, it has been submitted that the name of the petitioner has appeared in the present case in course of investigation.

Considering the facts and circumstances of the case, let the petitioner Harendra Yadav be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, II nd Class, Gopalganj, in connection with Gopalganj Town P.S. Case No. 158 of 2014.
