JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 This is an application for grant of anticipatory bail in connection with Bhagwanpur Hat P.S. Case No. 152 of 2018, disclosing offences under Sections 272, 273, 308, 420 of the Indian Penal Code and Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of huge quantity of liquor from a truck and the petitioner is also named in the F.I.R. Further, it appears that the petitioner is accused in 5 other cases of similar nature.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing has been recovered from his conscious possession. Heard learned A.P.P. also.

Having heard both sides, in view of recovery of huge

No.5578 of 2019(3) dt.07-02-2019 2/2 quantity of liquor and criminal antecedents of the petitioner, I am not inclined to grant anticipatory bail to him, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
