The petitioners apprehend their arrest in a case registered for the offence punishable u/s 384 and 387 of the IPC. After some arguments, learned counsel for the petitioners seeks permission to withdraw this application with regard to petitioner no.2 only.

Permission is granted.

Accordingly, the instant application with regard to petitioner no.2 is dismissed as withdrawn.

However, petitioner no.2 is at liberty to surrender before the learned Court below within six weeks from today and seek

Patna High Court CR. MISC. No.6607 of 2023(3) dt.04-07-2023 2/3 regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application. Now, this application is being heard on behalf of petitioner no.1 only.

As per the F.I.R., the informant being the proprietor of a Jewellery shop, received several threatening messages and calls for demand of Rs.50 Lakh extortion money.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. She is not named in the F.I.R. and has been falsely implicated in this case. Her name transpired in this case only on the basis that she is the wife of the named co-accused Lal Babu Singh @ Suman Kumar Singh @ Suman Singh, who is already in custody in connection with a kidnapping case. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. Petitioner no.1 is a lady and has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, let the above named petitioner no.1, be released on bail, in the

No.6607 of 2023(3) dt.04-07-2023 3/3 event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Darbhanga Town P.S. Case No.254/2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
