The petitioner apprehends his arrest in connection with Special Case No.118 of 2011, (RC-023 2011 0021)/ RC 21A/2011 registered under Sections 120(B) r/w Sections 420, 467, 468 and 471 of the Indian Penal Code, r/w 13(2) r/w Section 13(1)(d) of P.C. Act, 1988.
The accusation is that petitioner and 41 other persons took the loan to purchase the Tractor from the U.C.O. Bank, Gidhaur, District - Jamui on submitting the fake land possession certificate.
Learned counsel for the petitioner submits that admittedly petitioner took loan from U.C.O. Bank, Gidhaur,
Patna High Court Cr.Misc. No.30592 of 2017 (7) dt.30-11-2017 District - Jamui to purchase the tractor and the loan amount has already been paid by the petitioner to U.C.O. Bank, Gidhau, which would appear from annexure 2 to the petition. In fact, "No Dues Certificate" was issued by the Manager, U.C.O. Bank, Gidhaur. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge CBI Ist, Patna, in connection with Special Case No.118 of 2011, (RC-023 2011 0021)/ RC 21A/2011, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
