JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392/34 of the Indian Penal Code.

A very sketchy order has been passed by learned Additional Sessions Judge-VIII, East Champaran, Motihari and he has only mentioned in the impugned order that at para-25 of the case diary petitioner disclosed his involvement in the present crime. Moreover, it appears from the aforesaid impugned order that except confessional statement, there appears to be nothing against the petitioner, who is languishing in jail custody since

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in connection with Turkaulia P.S. Case No. 749 of 2015.
