The petitioner is not named in the first information report but in course of investigation, it was detected that the call for extortion money as well as threatening had been made from the mobile phone of the petitioner for which the petitioner is in jail custody since 21.01.2016. So far as criminal antecedent of the petitioner is concerned, it appears that earlier seven cases had been registered against him but in five cases he was acquitted of the charges.
Contention on behalf of the petitioner is that there was land dispute between the informant and petitioner and due to the aforesaid land dispute the informant implicated the petitioner in
Patna High Court Cr.Misc. No.18197 of 2016 (2) dt.02-05-2016 2/2 this false case. The investigation against the petitioner has already been completed.
Considering the facts aforesaid and submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Belsand P.S. case No.88 of 2014.
