====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2019 Heard the parties.

The petitioner seeks anticipatory bail in connection with Narhat P.S.Case No. 280 of 2018, registered for offences punishable under Sections 406, 420 and 120 (B) of the Indian Penal Code.

As per F.I.R., allegation against the petitioner is that the petitioner along with other accused Manoj Kumar have taken loan of Rs. 3,00,000/- and Rs. 4,40,000/-, respectively on 21.07.20015 and 24.09.2008 for purchasing tractors from Madhya Bihar Gramin Bank, Nawada but they have not paid the loan amount and not even returning the tractor. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case as he had not taken any loan for tractor from the Bank concerned

Patna High Court CR. MISC. No.5606 of 2019(3) dt.27-03-2019 2/2 rather his father was taken loan from the Bank for purchase of tractor in the year, 2008 and he has no role in this occurrence and he has no criminal antecedent.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Narhat P.S. Case No. 280 of 2018, to the satisfaction of learned A.C.J.M.-V, Nawada, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
