Petitioner seeks bail in Alauli P.S. Case No.105 of 2018 instituted for the offence under Section(s) 147, 148, 323, 324, 307, 341, 504 Indian Penal Code and 37(B) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that petitioner is in custody since 09.12.2018 having clean antecedents. It is alleged in the written report that this petitioner along with other co-accused, namely, Kunal Kumar and Subhash Paswan assaulted the informant on head causing injury to him.
Counsel for the petitioner submits that there is specific allegation against Rajeev Paswan and Rahul Paswan of
Patna High Court Cr.Misc. No.4978 of 2019(2) dt.30-01-2019 2/2 causing stab injury to the nephew of informant. Counsel for the petitioner further submits that coaccused, Rajeev Paswan and Rahul Paswan, have already been granted regular bail vide Annexure-2 series.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the In-charge Special Judge, Excise, Khagaria, in connection with Alauli P.S. Case No.105 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
