The petitioner apprehends his arrest in connection with Balthar P.S. Case No.44 of 2022, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 338, 353, 186 and 188 of the Indian Penal Code.

The prosecution case, in brief, is that on 19.03.2022, the informant alongwith other police personnel was on patrolling duty. At about 04.00 P.M. he got information that more than hundred people have obstructed the road after putting dead body of a person. When the informant reached there, the mob attacked on them.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as

It is further submitted that similarly situated co-accused persons have already been enlarged on anticipatory bail by this Court vide order dated 02.01.2023, passed in Cr. Misc. No.57751 of 2022. The learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M./Successor Court, West Champaran, Bettiah in connection with Balthar P.S. Case No.44 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
