In this case, the petitioner is apprehending his arrest in connection with Rail Darbhanga (Sitamarhi) P.S. Case No. 01 of 2017 registered for offences under sections 379, 411 of the Indian Penal Code.
In the present case, the stolen motorcycle has been recovered from the house of the petitioner but, the petitioner did not surrender and became absconder. Till date, the petitioner has not surrendered before the court below.
Learned counsel for the petitioner submits that the coaccused Gunjan Yadav has been granted privilege of anticipatory bail from the court below.
Patna High Court Cr.Misc. No.6027 of 2019(2) dt.04-02-2019 2/2 Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected with a direction to surrender before the court below within a period of four weeks from today, in failure to surrender within the aforesaid prescribed period, the Senior Superintendent of Police, Darbhanga will ensure his arrest and will produce him before the court below.
