This application for anticipatory bail arises out of Lakhisarai (Kabaiya) P.S. Case No. 606 of 2020 for the offence punishable under Sections 30(a)/32(ii) of the Bihar Prohibition & Excise Act, 2016.

Considering the fact that the petitioner has given the vehicle, in question, to one Mithun Kumar and there was an agreement with regard to the same, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.16327 of 2021(2) dt.03-12-2021 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II -cum- Special Judge (Excise), Lakhisarai, in connection with Lakhisarai (Kabaiya) P.S. Case No. 606 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The Investigation Officer of the case is directed to investigate the case properly and if the complicity of the petitioner comes during the investigation then he may file an application for cancellation of his bail in the Court below after submission of the chargesheet.
