Taking into consideration the period of incarceration of the petitioner coupled with the fact that no progress as such has been made in the trial of the case, bail application is allowed.

Let the petitioner, above-named, be enlarged on bail on furnishing bail bond of Rs. 25,000 /- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Katihar, in connection with G. R. No. 63 of 2014, arising out of Kishanganj Rail P. S. Case No. 16 of 2014. One of the sureties will be executed by a close blood relation and another by a person living in the area where the case was instituted after thorough

Patna High Court Cr.Misc. No.28226 of 2015 (2) dt.08-07-2015 2/2 verification with regard to the identity of the two persons standing surety.

It is made clear that if name of the petitioner surfaces in any other case instituted against him or is apprehended in any other case of such nature or otherwise the privilege of bail granted to the petitioner may be taken away.
