Petitioners apprehend arrest in a case registered for the offence punishable under sections 363, 366A, 307/34 and other ancillary sections of the Indian Penal Code and sessions 8 and 17 of the POCSO Act.

As per the prosecution case, all the FIR named accused persons including these petitioners assaulted the informant and his family members with lathi, iron rod, sickle etc, causing them injuries.

Learned counsel appearing for the petitioners submits that as a matter of fact, Shiv Kumar

No.8614 of 2023(2) dt.24-04-2023 2/2 Paswan and niece of the informant performed inter caste marriage against wishes of their parents as a result of which simple scuffle took place between their parents in which both sides sustained injuries. Petitioners are father and brothers of said Shiv Kumar Paswan. Case and counter case. No injury report is on the record. Petitioners claim clean antecedent. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge I cum Special Judge, POCSO Act, Samastipur in Sarairanjan Police Station Case No. 272 of 2002, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
