JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 27.02.2015 in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

It is alleged that the petitioner committed theft of `5 lakhs from the motorcycle of the informant when he was caught on chase and `5 lakhs were recovered from the petitioner then he was handed over to the police.

It is submitted by learned counsel for the petitioner that the petitioner was apprehended on mere suspicion. Moreover, the recovery was not made by the police. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Moreover, the investigation has already concluded. Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.26835 of 2015 (2) dt.28-07-2015 2/2 petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Lakhisarai in connection with Lakhisarai P.S. Case No. 143 of 2015.
