The petitioner seeks bail in Tekari P.S.Case No.294 of 2014 under Section 302 of the IPC and under Section 3(2)(v) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 15.04.2015 passed in Cr.Misc.No.6353 of 2015 along with Rishi Sharma. The case of the petitioner stands on the same footing as that of Rishi Sharma and Rishi Sharma has already been enlarged on bail vide order dated 03.08.2016 as similarly situated co-accused, namely, Uday Shankar Sharma, Satyendra Sharma, Chhote Sharma @ Chhotu Sharma @ Gautam and Futu

Patna High Court Cr.Misc. No.19978 of 2016 (2) dt.07-09-2016 Kumar were granted bail by different Benches of this Court vide order passed in Cr.Misc.No.52712 of 2015, Cr.Misc.No.43803 of 2015 and Cr.Misc.No.19297 of 2016. It is submitted that the case of the petitioner also stands on the same footing. Considering the facts that similarly situated co-accused persons have already been granted bail, the above named petitioner is also directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court, SC/ST (Special Judge), Gaya in SC/ST Trial No.49 of 2016 arising out of Tekari P.S.Case No.294 of 2014.
