JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 29.3.2015 in Turkauliya (Banjaria) P.S. Case No.259 of 2015 for the offences under Sections 363, 365, 366-A, 504 of the I.P.C. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that there is accusation against the petitioner along with other co-accused of kidnapping of the daughter of the informant for the purpose of marriage. On receipt of the information the informant went to their house to release the victim girl the petitioner along with other coaccused abused and refused to do so. On behalf of the petitioner it has been submitted that she is in custody since 29.3.2015 and charge sheet has been

Patna High Court Cr.Misc. No.27119 of 2015 (2) dt.29-07-2015 2/2 submitted in the case. The petitioner has no criminal antecedent. She is said to have been made accused in this case due to mistake of fact.

On behalf of the State it has been submitted that the petitioner has been named by the victim in her 164 Cr.P.C statement.

Considering the aforesaid facts and circumstances, let the petitioner, above named, after completion of six months in custody since 29.3.2015, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., East Chamaparan at Motihari, in Turcauliya (Banjariya) P.S.Case No.259/15.
