The petitioner has preferred this application for grant of regular bail in a case registered under sections 394 of the Indian Penal Code.

As per the prosecution case the three unknown accused persons robbed the informant of his mobile phone as also Rs. 4,000/- in cash, It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. No incriminating article has been recovered from the possession of the petitioner. He has not been put on T.I. Parade and charge sheet has been submitted in the case. The petitioner is in custody since 21.1.2020 and has been falsely implicated in the case because of

Patna High Court CR. MISC. No.15837 of 2021(4) dt.14-09-2021 2/2 his antecedents. It is finally submitted that similarly situated coaccused Amit Kumar has been enlarged on bail vide order dated 8.1.2021 passed in Cr. Misc. no. 34288 of 2020. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case including the petitioner not having been put on T.I Parade and grant of bail to co-accused, the Court directs the petitioner to be enlarged on bail in connection with Sitamarhi P.S. Case no. 624 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
