The petitioner seeks bail in Mehsi P.S. Case No.21 of 2016 instituted for the offences under Sections 401, 413 and 414/34 of the Indian Penal Code.

As per First Information Report police party has intercepted group of accused persons and from the possession of the petitioner as per allegation of the police stolen motorcycle was recovered. Petitioner has criminal history. Learned counsel for the petitioner submits that in all the cases mentioned in paragraph 3 of the petition where First Information Report has been lodged against unknown and in all the cases petitioner has been shown to be an accused,

Patna High Court Cr.Misc. No.18289 of 2016 (2) dt.02-05-2016 charge sheet has been submitted. Petitioner is in jail since 10.2.2016.

Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the petitioner will be at liberty to renew his prayer for bail after completion of nine months in jail custody.
