The petitioner is accused in connection with Jokihaat P.S. Case No. 326 of 2015, registered under Section 467, 468, 471, 420 and 409/34 of the Indian Penal Code. The accusation is that petitioner being the Panchayat Secretary in connivance with the Mukhiya of the Gram Panchayat committed irregularity in the financial year 2007-08 for installing the solar light in 12th Finance Commission Scheme and misappropriated the money of exchequer.
Learned counsel for the petitioner submits that admittedly the petitioner was Secretary of Gram Panchayat, but has retired from the said post in the year 2012. The irregularity is said to be done by this petitioner for the work of installment of
Patna High Court Cr.Misc. No.19574 of 2016 (2) dt.09-05-2016 2/2 solar light in the year 2007 and the report under which irregularity said to be caused in the year 2015 after seven years of the occurrence. The petitioner is in custody since 20.03.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Jokihaat P.S. Case No. 326 of 2015.
