JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 291(C) of 2017, disclosing offence under Section 498(A)/34 of the Indian Penal Code read with Section 4 of D.P. Act.

Allegation against the petitioner as per complaint case is that for demand of dowry subjected her to torture and harassment and ousted her from the house.

Considering the stand of the petitioner that he is ready to keep her with dignity and care. On appearance, matter was referred to the Patna High Court Mediation and Reconciliation Center. Now the report of Mediator is available at Flag 'B', which disclosed that due to non appearance of the opposite party

Patna High Court CR. MISC. No. 9299 of 2019(4) dt.17-07-2019 2/2 no.2, mediation failed.

Submission of learned counsel for the petitioner is that the whole allegations are false and concocted and no specific allegation has been attributed against him and he is ready to keep her with dignity and care.

On the other hand, learned counsel for the opposite party no.2 has opposed the prayer for anticipatory bail on the ground that the she was subjected to cruelty and harassment with respect to illegal demand of dowry.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below on 24.07.2019 and on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Complaint Case No. 291(C) of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
