The petitioner has preferred this application for grant of regular bail in a case registered under sections 395 and 412 of the Indian Penal Code.

As per allegation in the FIR, accused persons on Scorpio vehicle looted the truck. After sometime the truck was found parked. The vehicle was surrounded and while some accused persons managed to escape others were caught. The accused persons who were caught disclosed the name of the petitioner and others.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He was not caught at the place of occurrence. There is no material

Patna High Court CR. MISC. No.15758 of 2021(2) dt.11-08-2021 2/2 against him except the confessional statement of a co-accused made before the police. His case stands on a better footing than that of other co-accused who have been enlarged on bail vide order which are Annexure-2 series to the petition. The petitioner is in custody since 13.10.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts in the case, grant of bail to co-accused and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Bihta P.S. Case no. 74/2019 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Danapur, District Patna.
